On July 1, 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 862 "On Amendments to the Resolutions of the Cabinet of Ministers of Ukraine of January 27, 2023, No. 76, and of May 30, 2026, No. 692." The document introduces a new mechanism for confirming the status of enterprises recognized as critically important for the functioning of the economy and ensuring the livelihood of the population during a special period, and also provides for changes in the procedure for reserving military-liable workers.
What enterprises need to take into account when re-confirming their critically important status, and which documents must be submitted by August 10, 2026, is explained by experts of the Ukrainian Agri Council, within the framework of a project to support Ukrainian agricultural producers from affected regions in partnership with the international humanitarian organization Mercy Corps.
In accordance with Resolution No. 862, if enterprises that have already been designated as critically important submitted, by August 10, 2026, a certificate on the amount of the accrued average wage of insured employees and a tax calculation of income amounts for the last calendar month confirming compliance with the wage criterion, the decisions on determining criticality will remain in effect for the period for which they were adopted.
This concerns confirmation that the accrued average wage at the enterprise is no lower than the amount of the minimum wage in the country multiplied by a factor of 3.
At the same time, this provision does not apply to enterprises whose critical status is annulled in the event of the exclusion of the criterion on the basis of which the enterprise was designated as critically important before July 1, 2026.
The Ministry of Economy informs that Resolution of the Government of July 1, 2026, No. 862, approved a simplified procedure for confirming the status of an enterprise, institution, or organization as critically important.
Also, Order of the Ministry of Economy of June 24, 2026, No. 6954, approved the criteria for determining enterprises, institutions, and organizations that are of important significance for the sectors of the national economy.
To go through the simplified procedure, an enterprise must, by August 10, 2026, send to the email address of the Ministry of Economy meconomy@me.gov.ua a cover letter signed with the qualified electronic signature of the head, as well as the following documents:
- a certificate on the amount of the accrued average wage of insured employees;
- a tax calculation of the amounts of income accrued or paid in favor of taxpayers — individuals, and the amounts of tax withheld from them;
- a tax calculation of the amounts of the accrued unified contribution to compulsory state social insurance for the last calendar month.
Enterprises whose critically important status expires in less than three months may submit the full package of documents through the State Agrarian Register to confirm or determine the status of a critically important enterprise.
